Please do a search on this site for several other postings about William Hogarty, New Credit RX and O. F. Lending. The Department of Real Estate is trying to revoke both William Hogarty's personal license to do loans in addition to the company's license. There are several reasons listed on the report, with the most serious being his failure to deposit trust funds into a nuetral account (he spent the money instead of holding it in trust). There is also an other investigation taking place and charges may be filed. Please contat me directly if you have been scammed by William Hogarty or his company so I can put you in touch with the right people. He has said in other postings that the fact that he lives a lavish lifestyle (mansion with a 9 car garage, 100 foor yacht and a brand new camaro) doesn't matter. I beg to differ as do his victims as he says he doesn't have money for refunds and can't return trust funds he stole because he doesn't have money. He should sell all this crap that he is paying for by stealing from clients so he can pay some of his victims back. He's living this way on the dime of his many many victims. So Bill, IT DOES MATTER. Sell the car and pay someone back. Sell the yacht and pay your payroll. There are people you have ripped off that are having a hard time paying for food while you live in a mansion with their money. Are you so arrogant that you can't see that this isn't okay?

My name is Rick Monge, I am an investigator with the Alameda County District Attorney's Office. My office has received several complaints about OF Lending.
I would like to speak with individuals who have had positive or negative experiences with this company, Mr. William Hogarty or Mr. Jim Rivera.

I need to quickly point out that Christy Hogarty is just as guilty of fraud and theft and you should go after her personally in addition to William Hogarty. She is/was the company controller and had access to all funds, including the trust funds that were stolen. She was very involved with the short pay scam, she deposited all the client payments and ran their credit card payments. She signed almost all checks and transferred money from the trust and operating accouts and into their personal account. She too is living large (living in a mansion, a rock on her hand and regular trips to Mexico). All short pay refi clients' files had to go through her personally for her approval before they were processed. She knowingly accepted funds from borrowers that didn't qualify and cashed these same clients' checks. She had full knowledge of what was going on and personally lived on the scammed and stolen money. This information has already been given to the DA's office so it would appear that she'll go down with her husband since they were both so involved in the whole scam. .
William Hogarty and OF Lending scammed me out of $2,000. I signed up for a short pay refinance and it's been over a year, and as far as what my lender is telling me, I don't think OF Lending sent them a thing. I first signed up in September 2009 after they reduced the price from $4,000 down to $2,000. When I signed up, they said the chances that my short pay (principal reduction) would be approved were between 70% - 80%. When my wife and I were there meeting with the loan officer, she introduced us to William personally and he assured us they could get the job done. It was after meeting him and having him swear to us that they would do right by us that I finally signed up and paid the $2,000 fee. We were also introduced to Jim Torpey who we were told would be the negotiator assigned to us and that he would personally take care of our loan. What a disappointment when he later refused to even return our numerous phone calls.
When we signed up, we were told we would get a weekly update. This lasted for a short time, but after our loan officer left the company, the contact from them became more and more sporadic. At one point, we went about five months without hearing a thing. We were handed off from person to person and told time after time that person after person had left the company. After trying and trying to reach them and not hearing back, I finally showed up at their office only to find that the doors were locked even though it was normal business hours. I returned a second time since they wouldn't call me or return my phone messages only to be told that the person I needed to speak to was "unavailable". We finally ended up speaking to Michael Anne Hogarty who I assume is related to William Hogarty. We got no answers and just more runaround.
The few times we did manage to make contact with them, they had us fill out the same forms for the bank over and over again. We later talked to our bank, and they seem to have no record of being contacted by OF Lending at all.
I have since spoken to a former employee of William Hogarty's who has informed me that this is all a scam and that William Hogarty is being investigated by the Alameda County District Attorney's Office for theft and for illegally accepting advance fees. He is also being pursued by the Department of Real Estate for stealing trust funds and for illegally accepting advance fees. It seems that we fall under this group of clients that paid an advance fee for services where it is illegal to do so. William apparently knew this all along, but continued to do it. I have seen emails from him where he admits he was wrong and where he even admits a trust account didn't exist even when dozens and dozens (maybe more) of people had money with him they believed was being held in trust for them by William and and his wife Christy Hogarty.
I plan to pursue whatever avenue I can to get my money back. This man is a thief and is living large on my money (from illegal advance fees) and from money he was supposed to have in trust. I encourage you to contact the District Attorney's office if you paid this man or company for a loan modification or short pay loan. I plan to do this myself in the coming days as I won't be ripped off like this.

On 10/26/10, the Department of Real Estate filed a "Desist and Refrain" order against both William and his company. You'll need to have his license number which is 01108686 and the complaint number which is H-11018 SF.
If you paid any sort of advance fees for a loan modificaiton or short pay refinance, the Department of Real Estate is requiring that he put all such advance fees collected into a trust account. They are also requiring that he provide required trust accounting records to all clients and I believe they are to be sent out monthly. If you paid advance fees and don't receive a trust account statement from him, it is imperative that you contact the Department of Real Estate and file a complaint. Further, and as stated above, there is a criminal investigation into William Hogarty's actions and that of his wife, Christy Hogarty. If you paid advance fees for a short pay refinance or a loan modification, it is imperative that you contact the District Attorney's investigator even if you've received a partial refund. the investigator's name is Rick Monge. William will likely post on here or comment to others making himself out to be a victim. He'll say he can't follow through on clients' loans and that people are going to lose their jobs because either I personally or other "haters" are out to get him. In reality, all this is happening as a direct result of William and Christy's illegal actions, theft and fraud and they are the only ones to blame. Those customers that have paid for services were scammed by them as their success rate is far less than they have claimed and they use the clients' money to support a lavish lifestyle. William and Christy are not victims, they are thieves and crooks.

I asked William Hogarty, on tape, what we had paid for. He responded, ‘Hope.” I PAID $10K FOR HOPE!
Like many other people out there my wife and I are suffering from the economy so we went to OF Lending (William Hogarty, “Bill”) for some help. We met with Jim Rivera, the VP of the company. We were filled with joy when they told us that they could help. Jim told us that we were already approved for a new loan but they needed to do it quickly so we could be lumped in with a bunch of other houses going to Wells Fargo the end of the week. Jim said that they use a group approach to get the best results. They told us that Wells Fargo was one of their premier lenders and that they had a great relationship with them.
We were told that their services were based on what they could save us. They came up with a matrix, which i still have, showing that we could pay them 10K now or 17K later. We fell for it. We gave them the 10K in advance of any services on good faith. We were then presented with the contract and rushed through it. We were told that it just says everything that we were already told. This was a LIE. Deep in the wording of the contract it says that we were not paying for any advanced services. But come on, 10K for a consult? Really?
Since then all they have done is collect the information we send them and forward it to Wells Fargo. We then got a letter from Wells Fargo saying that our request for Short Pay Refi was denied because not all the needed information was supplied to them. We found this a little odd because Jim and William said that Wells was a Premier lender of theirs and that they had a good relationship with them. I would assume that if this was the case then the info sent to wells would have been complete.
Jim and William suggested that we short sale the house, at this time I was very suspicious and wondered his motivations because at every step Jim was telling me that he had done the same thing with his house. Things were just not adding up so i told them to sit on it a little while we decide what we are going to do.
I little while later we got an email from a Ryan Michelle stating that he was taking over the case and he does not give up, blah, blah, blah. Ryan Michelle is an assistant or secretary to Jim Rivera. He was NOT authorized to take over our file. At this point we were done with OF Lending and all people associated with them.
We told them such and that we would like to have our money back. There were no result and we were told that was what we were paying for. So we asked for a refund. Bill emailed me back trying to be friendly and asked for a meeting, I said that i wanted everything in writing between us then he said yes everything should be in writing. Then William asked me to produce the paper that said there was a guarantee and to look at #4 in the contract. #4 states
"client has been advised, and understands that this is not an agreement to secure a Short Refinance. Client has been advised, and understands that this is not an agreement to perform loan modification services. Broker will not attempt to negotiate a loam modification or short refinance for Client."
So.... we were paying for the 2-3 hour consultation? $10,000.00 seems a little steep for that, wouldn't you agree?
I asked for my money back again sighting the "Honesty and Integrity" that is posted at the bottom of his emails and website. He proceeded to tell me i was looking for a fight and told me that no one ever collects and he was going to hand it over to the legal department.
I then agreed to a meeting because what recourse do i have?
We went to that meeting and have a recording of the whole thing, authorized by Bill and Jim. In the meeting Jim States that he did say we could get a refund.
Since the meeting we had agreed on $5500 back but when Bill sent us the Settlement Agreement it was doomed to fail. He put clauses in the agreement that he knew we could not accomplish therefore voiding the contract and the money he would have to pay us. So we had the agreement rewritten. The only change has the timing in which we wanted to be paid and that the contract/agreement was not binding until we received the total refund amount of $5500. He said nasty false things about me, others and threaten to contact the USCG to complain about me. These are direct quotes from his email.
We wanted %2750 within 7 business days and the remaining $2750 within 14 business days. We thought that was fair as seeing that we gave him 10K.

It seems to me that Bill and Jim are scam artists and conned us hook line and sinker! William Hogarty and Jim Rivera need to be stopped

My name is Lisa Parin. I worked for William Hogarty and Christy Hogarty at OF Lending. I just read "Capt. Ben's" post and wanted to comment.
William and Jim Rivera's story to Capt Ben as to how they calculated their fee for short pay services is based on lies. There was never an official matrix that had some formula that the fee was based on. This was created as a sales tool by William and Jim Rivera to try to milk desperate prospective clients into paying higher fees. The fee schedule was VERY simple. Someone could sign up for a short pay for as little as a $2,000 flat fee regardless of how much the company was to save them. When a loan officer/VP could get the customer to pay more like in this case, they loan officer/VP was paid a higher percent in the form of commission for the more they collected (scammed) out of the borrower. So the more they customer paid, the higher percent of the amount the loan officer/vp would be paid. They would actually brag every time they got someone to pay more referring to say a $10K deal as a "10 pounder". They would bring these "successes" up in staff meetings and pressured all the staff to collect more than the $2,000 fee that was required. I worked for William during this time and he actually had a "talk" with me to let me know he was unhappy that all my customer were only paying $2,000. It is important to note that the services the person that paid the $2,000 fee were the EXACT same that the person that paid $10K or $20K recieved. The file was handled by the same people and same negotiators so the client didn't get more when they paid more. One employee actually questioned this practice and found herself without a job shortly thereafter. It was no coincidence.
There was never a "premier" relationship with Wells Fargo. His former company, Olympia Funding, might have enjoyed this status, but the new company he set up, OF Lending, to hide/escape from all the liability of the old company probably did fewer than ten loans with them over the first year. Hardly what is required for any sort of "premier" status with Wells Fargo or any other lender for that matter.
The "we are grouping your loan with other Wells Fargo loans" story was just a BS sales tactics that they attempted to teach all of us to use and with any lender the client said they had. So one day it was Wells Fargo loans they were grouping, but by the afternoon the so called lender they were grouping for could have been Chase or Wachovia or any other bank the client had. I think it comes from Jim's days as a car salesperson (seriously) and if I remember right they called it some sort of "bucket" tactic. I can't swear by this name, but it was something like that and meant to collect more from potential clients. We seriously were trained by Jim on this "technique".
I have withheld my comments about Jim Rivera until now because I always had a good working relationship with him and I actually quite liked his family and his dedication for his children. HOWEVER, I have since been contacted by person after person that paid anywhere from $4K to $32K for this "short pay" fraud and most of them have been people that signed up with Jim directly. I'm not sure I can support him any longer when I hear the variance in what his customers paid for the exact same thing and the fact that he made promises that he knew OF Lending and William Hogarty could not deliver on. Further, his is definitely aware of all the victims that have come forward looking for a refund of some sort or who signed up based on inflated success claims and yet he still works for William Hogarty, Christy Hogarty and OF Lending. I feel the right thing for him to do would have been to leave this company because it is very clear they are running a scam, yet for some reason he stays and continues with this fraud. I will say that William Hogarty and Christy Hogarty owe their employees thousands in back pay so it could be Jim is only there because he knows if he leaves he will never get paid. I actually hope this is the case because I can't think of another reason why he would stay.
Continue to follow this and other blogs if you are a victim. Many many victims have come forward and have also met with the District Attorney and they definitely want to talk with anyone that has been scammed by William Hogarty, Christy Hogarty or anyone that works for his company OF Lending. Looks like William Hogarty is about to file for bankruptcy. He owes his employees thousands and thousands of dollars and is apparently going to try to get this wiped away with this filing. This is what he specifically said to someone that he owes commission to. If he does this, I think he believes it will wipe away the numerous refunds that are owed to the people he scammed with his short pay and loan modification scam. This includes people that are supposed to have funds in trust with him. This is very sad. If he owes you money, file a small claims suit ASAP and make it against him personally (not the company). I believe this is the only way anyone has a chance of recovering anything. Before you go to court, contact me so I can show you where the law makes broker personally responsible for the actions of their people. He won a recent appeal by saying he shouldn’t have been sued personally and by hiding behind his corporation. I frankly wasn’t prepared for this argument so couldn’t overcome it. If this comes up again, I think even the Department of Real Estate will provide the statutes that show in a real estate or lending company that the broker is personally responsible. In addition, he took the customer money and moved a large chunk of it into his own personal account (that he co-owns with this wife, Christy Hogarty). He might now have an off shore account per a former employee of his. Email me if you need his home address for a complaint. I’ll happily send it to you.
If you feel you have been scammed by William Hogarty, if you are supposed to have money in trust with him or if you are an employee that he hasn’t paid, I implore you to contact Kurt Reisig who is the CEO of American Pacific Mortgage. This is the company is planning to merge with since his own real estate licenses are about to be revoked. Please call Kurt and tell him about your own experiences with him so he’ll reconsider his decision to join forces with William Hogarty and/or his company. I can’t imagine anyone would knowingly jump into a business relationship with someone with a past like William Hogarty’s.
Finally, I have now heard many of the lies he tells about me and others that have outed him. He will lie about what happened with me and other people because he has no other defense to everything that has been reported. Just know that he’s a liar and will say anything to get himself out of hot water. Everything we are writing is 100% true. I stand to gain nothing but a headache by posting on here whereas he stands to gain a better position and less embarrassment if he lies about me and the others. I am being contacted by 2-3 people a week that have been scammed by him or by employees that he owes thousands to. His path of destruction is long and his victims probably number in the hundreds. When he tells you he won a case against me, just know this is false. I filed one lawsuit against him and was promptly contacted by his attorney who reached an out of court settlement with me that included HIM writing me a check. If he says anything different, it's just another lie.
I’m going to post a few emails I exchanged with him once I outed him. You’ll see in them, and in his own words, that he knows he is wrong. Stay tuned.
I have heard now that the Attorney General, FBI and now the US Attorney (federal) is also investigating him.
I am a former employee of, OF Lending and William Hogarty. He is doing a merge as we speak with American Pacific Mortgage. He is getting his DRE Brokers License revoked. The new setup is not going to have his name anyhwere on the agreements, contracts, or records so there will be no way anyone will know he is going to be involved as a silent partner. Although He will still be running the show.
William also has a Real Estate company called Gold Star Realty. This will be under a different brokers license. He's going to have a separate office for Gold Star Realty and will still be running the show there too as well.
Nobody has mentioned his off shore Cayman Island bank account yet. or his new boat that he already has, or is getting.
Mr. Hogarty owes me quite a substantial amount of money, from a loan transaction that I closed over 6 weeks ago, that I have not been paid on as of yet. After weeks of him assuring me I will get my money he never comes through. Now after me turning the heat up on him and threatening to escalate this, and pursue him legally. His repsonse was that he will just claim me in his Bankruptcy that he is planning on doing in the near future. That way he won't have to pay me. This is unbelievable and shows you what type of person he is. I have reiterated to him multiple times, that such as himself, I have a life too. I have a daughter who is a toddler, a mortgage, and bills I have to pay. At this moment in time I have $5 in my bank account, an empty refrigerator, and a 15 day notice that my PG&E is about to be shut off. Mr. Hogarty has no empathy for these issues that he has caused me to be dealing with at the moment. I am not the only one he owes money to either. Just about all of his current and former employees he also owes money to as well. Most of these individuals will not "rattle the cage" so to speak, in fear of never getting paid. He uses his employess hard earned commission to pay for his bad business decisions to give his clients refunds and to pay other payroll that is behind. I will post DAILY updates here on this site letting all of you know what the status is until he pays me. I am not going away!
So if Mr. Hogarty owes you $ i suggest you act fast because he will manipulate you and stall you for as long as he can

JIM RIVERA Is not the guy you want to pursue for any of the negative experiences you have had with William Hogarty's company OF LENDING GROUP. JIM RIVERA is a victim of MR. HOGARTY'S bad business tactics and is being accused wrongly of any bad doings. Anything that JIM RIVERA has sold or been told was because he believed in WILLIAM HOGARTY AND WAS MISLEAD BY THE INFORMATION HE WAS GIVEN BY MR. HOGARTY. HE ONLY DID WHAT HE THOUGHT WAS RIGHT AND WAS TRYING TO HELP PEOPLE GENUINELY. JIM RIVERA WAS AN INNOCENT AND HONEST EMPLOYEE. HE WAS FOOLED BY MR. HOGARTY'S MANIPULATIVE TACTICS AND CEASED FROM DOING ANYTHING DECEPTIVE TO ANYONE AFTER HE FOUNDOUT THAT THE SHORT PAY REFINANCE PLATFORM WAS NOT GETTING THE RESULTS HE WAS ASSURED FROM MR. HOGARTY.
It has come to my attention that many people are having a hard time making contact with Mr. Hogarty directly and that he is not returning phone calls to many. I therefore wanted to pass along the best contact number that I have for him. You can try him on his direct line at 925-200-2010. I believe it also rings on his cell phone so you can call him after hours/weekends as well.
If you are a victim, be sure to call Rick Monge at the DA's office. I cannot stress this enough. I believe William Hogarty thinks he can wipe out all his debts, including refunds to clients and payroll due to his employees with a bankruptcy filing, but what he doesn't seem to realize is that you can't get a debt discharged in bankruptcy if it was as a result of fraud. Since he quoted a success rate on short pays of 70%, the fact that the real success rate is 5-10% means he committed fraud when he collected payments for these services and when he lied about his success rate. Judgments by EDD are also not discharged in a bankruptcy filing so if you are an employee that is owed wages or commissions be sure to immediately file a complaint with the Labor Board. I assure you that they already know him quite well.

I wanted to support something that was posted on this web site on another post. Please read this.
American Pacific Mortgage, the company that was in the process of working with William Hogarty to employ all of his people, have decided against moving forward with this transition. THEY WILL NOT BE HIRING MR HOGARTY OR HIS ASSOCIATES. I wish to thank those people that took the time to contact the CEO of American Pacfic Mortgage as I believe these calls and emails directly impacted this company's decision to hault it's dealings with Mr. Hogarty and his company.
There is no longer a need to contact the CEO at the number and email I provided earlier. This appears to be a company and a leader of integrity and they have made the right decision after better understanding Mr. Hogarty and his company.
I just wanted to let everyone know that I do not work for OF Lending Group any longer. I also have NO affiliation with Bill Hogarty. I am in the process of cooperating with the parties involved to make sure that I can do anything possible to help in anyway I can.
I received a call from Oakland that William Hogarty is trying to surrender his Department of Real Estate license instead of having it outright revoked. In my view, this is NOT a good thing. There are new laws that go into effect 12/1/10 that require a new endorsement with the Department of Real Estate (called NMLS) which you cannot get if you have ever had a license revoked. If he is allowed to surrender his license, I believe this leaves the door open for him to get it reinstated in the future. You are completely disqualified from ever obtaining the NMLS endorsement if you have ever had a license revoked. For this reason, and to protect the general public going forward, his license needs to be revoked. If you are a victim, and even if you have settled with him and received a partial refund, it is imperative that you contact the Department of Real Estate and file a complaint. They have filed a formal complaint already against William and OF Lending, but they are still taking new complaints which I'm hopeful could help with additional DRE charges/allegations against him so he will have is license outright revoked and will never be able to do loans again. If you need the DRE investigator's contact information, just email me and I will send it to you. ADDITIONALLY, if you are a victim, and even if you settled wit him, it is imperative that you contact Rick Monge at the DA's office to help strengthen the potential criminal case against him and to help them be able to reach a conviction should they file charges. With the new NMLS endorsement that is required by law as of 12/1/11 to do loans, you cannot ever have had certain types of convictions (including fraud and theft of money). If you have been convicted of these types of crimes, you can't EVER get the endorsement and cannot legally do loans anywhere in the country. Additionally, if they ultimately file charges and get a conviction, there could be some sort of restitution ordered and you therefore want to be sure you are included as a victim to that you might at some point be eligible for court ordered resitution.
OF Lending's office has probably less than give people left at this point. It is my concern that he is going to completely shut down the office. If you are filing a complaint or lawsuit against him, it is imperative that you file it against him personally and use his home address. There has been a statement made on here that Bill's house is in foreclosure. According to county records, there is NO record of any formal foreclosure action that is being taken. This is true for another property he and his wife own in Livermore as well. So I believe this is false. There was also a statement that he is trying to sell his house. It is true that he listed it for sale, but he has it so overpriced that there are no takers. To me, this means that he has equity (money) left in the property because if he did not, he would price it aggressively as a short sale. He's trying to get top dollar so he can get his money out of it. Under a short sale, it's the bank that takes the hit because the owner has no equity. Additionally, if he truly wanted to sell the house, he would price it correctly instead of what he is doing. He's been told that it's overpriced and doesn't seem to care. In my view, this might mean that he has it for sale knowing that at the price it's at it will never sell, but that he can tell people that he is "even trying to sell his house" when the public is outraged to learn he's living in a mansion on money he stole from customers and money he owes his employees.
I realize some might find this entertaining to watch play out, but I need to point out that the people that he scammed were people that were NOT behind on the mortgages and have lived up to their mortgage obligations. William required that these same people stay current on their mortgages throughout the process which has lasted over a year for some. So these aren't people that were in default or had even ever been late on a payment. These are responsible borrowers living up to their obligations and that were scammed by Bill because they were trying to do the right thing and make things right with their current lender. Please understand that there is no humor in any of this and some of his victims are going without necessities as a result of the scam. So well William is living large in a mansion on 100 acres (that he clearly isn't really trying to sell) and driving a new car, some of his victims are struggling to pay for basic necessities and are TRULY selling their homes and in least two cases, are being forced to move in with family members. William says he can't afford to pay people back, but as long as he continues to make payments on his mansion, yacht and car, he can in fact afford refunds. Get rid of the toys and stop paying for them and maybe it would be believable. He should take those same payments and mail them to a victim instead. I'm sure many would take payments from William if it meant getting their money back. Or sell the diamonds Christy Hogarty is draped in. If he THEY can't afford to pay back money they collected by committing fraud, they can't afford for her to have all these diamonds. In fact, the money that they still spend on her upkeep (weekly nails and expensive hair color/styling) should instead be sent to his victims. If they can afford $50 a week for her to get her nails done, they can afford to send this money to a victim. $200 a month is better than nothing. I know many of his victims can't afford groceries and utility bills let alone manicures and pedicures or an expensive haircut and color. It's disgusting and should not be viewed as humorous in anyway.

If you contact her and she says she can't do anything because she doesn't deal with these issues or have authority to approve refunds, just know this is false. She can sign on all accoutns and knows the balance in each account every minute of every day. She knows when or even personally writes checks for their mansion, yacht and cars are being paid for and knows that this money could be returned to victims instead. So don't let her fool you. If she wanted to return your money, she could.

If you are a victim, have a barf bag handy as you'll likely need it once you see how they are living on your dime. They only have 10 bathrooms and a nine car garage. How do they manage to live in these conditions? And know that his porshe and restored camaro that runs on alcohol and that he shows in car shows are parked in the very garage as listed. So when they say they can't pay people back because they don't have money, they could just sell even one of the cars and would easily be able to pay multiple people back.

I just checked with the county and William and Christy Hogarty's property taxes on their mansion are CURRENT. This means he is finding the money to pay a $44,702 per year tax bill for himself, but says he has no money to pay refunds to his victims or to pay his employees that he is months behind paying. This comes out to $3,725 PER MONTH. He could take this $3,725 every month and pay one victim back every month instead of paying for his own mansion. Keep in mind, this is just for his property taxes. If his property taxes are $44,702 per year, how much do you think his house payment is? And how much do you think it costs him to maintain the property? He says the house is in foreclosure, but county records contradict this and they have to have been notified with a Notice of Default by the lender before any foreclosure can happen. AND, I assure you that if the house was in danger of being foreclosed on, the last thing he'd do is pay his property taxes. Also, if he were trying to short sale the house, he wouldn't be so foolish as to pay his property taxes then either. The only reason someone in his position would pay this outrageous tax bill is if they are protecting the equity in the house and if they were planning on staying.
So while you might be struggling to pay your own tax bill because of money he scammed you out of, rest assured that he is using YOUR money to pay his own. Disgusting.

Bill is now claiming to be over a year behind in his mortgage. Very interesting since the county has no record of foreclosure proceedings by his bank. What's even more interesting is that not six months ago and under oath and during a hearing in front of a judge, Bill Hogarty stated he had "perfect" credit. Now how can that be true if he is over a year behind in his mortgage payments? So he either lied to the judge under oath about his perfect credit or he is lying now. Both certainly can't be true.
Bill is now saying he surrendered his DRE license. While I hope this is true, I would have preferred that it be revoked. For this reason, please continue to complain to the DRE and DA so it might result in additional DRE charges and a possible criminal conviction which would close the door to his being able to operate in this business at anytime in the future. He is claiming he is a victim and did nothing wrong. No why on earth would he agree to surrender his license and his career of over twenty years if he truly did nothing wrong? It doesn't make sense and when something doesn't make sense, it's usually because it isn't true. I believe he surrendered his license because he knows the DRE and DA have evidence that proves he stole customers' trust funds, illegally charged advance fees and committed fraud. Never would he have surrendered his license if he didn't know they had him and that his license was going to be revoked and that his own freedom and that of his wife might be at stake. Anything he said during administrative hearings with the DRE probably could have been used against him in the potential criminal case so he did the only thing he could do and folded.
Many people have asked why I am so willing to help. My intentions are pure and I believe in paying it forward. This man ripped me off personally so know I am also a victim. He even knowingly put the lives of my two children at risk all so he could get money out of me. He has pleaded with me to stop, but I have told him that I will not stop until he starts telling the truth and pays all his victims back. He has yet to do this and continues to lie even today so he can expect me to continue. I can't believe that he still hasn't learned anything from all of this. If you need help, I'm happy to try to assist you as I personally know how dangerous this man is and what he is capable of. He will say that I have it out for him, which is actually true, and I'm not afraid to say so. I am disgusted by all the lies he told and how he stole hundreds of thousands of dollars from so many and paid for his lavish lifestyle in doing so. So yeah, I do want to help put him out of business and stop him from continuing to do this. If this means that I have it out for him, then so be it.
I am copying and pasting this post that was written on my behalf. Until now I have not attempted to defend myself. I am now starting to do just that, as the name I have established and reputation in this industry that took years to establish, is now being questioned. I will work diligently and within the scope of this investigation to show and prove that the things that may be said or believed to be true have another side of the story. I have prepared a blog that will be attached shortly and begin the process to clear my name by both explanation in blogs, and through a judicial process as well. The posts are taking a negative affect on me and my family and I ask to please consider and feel free to contact me before placing judgment solely on the negative things that are posted about me. OF Lending Group and a positive experience with Jim Rivera
I would like to write this blog in defense of Jim Rivera and the negative things that have been reading. I have had the pleasure to work with Jim over the last 2 years. I was referred to him by a Realtor that claimed he was the most up front and stand up guy.
Upon meeting with Jim I appreciated his up front disclosures, about him not wanting to give me false hopes, and although, that was not what I wanted to hear, I was relieved by his honesty. Through my process which started with me asking him about the short pay refinance that I viewed on TV by William Hogarty, I ended up continuing forward with a different program that Jim suggested as he didn’t believe the Short Pay would fit my situation. Although I somewhat still believed it to be the answer for me as I trusted Jim to make sure he took control of the situation I was in and prayed, it would be better then my current situation. Jim was great at responding and always made me feel at ease whenever I became nervous. In the end I was able to complete a refinance since my home was not to far from being upside down. I thought it was impossible to refinance a home that had no equity and with Jim’s Knowledge and fortunately not allowing me to do the short refinance that I called him on, I was greatly appreciated for his effort and more importantly his honesty. I have no rebounded from the sleepless nights and concern over loosing my home. This is solely because of Jim Rivera. For this I will stand behind him and represent him as a person that does not feel he would ever mislead someone intentionally to do something wrong. If that were the case then I was a possible victim as I was willing to do anything to save my home when I contacted him.
I am writing in response to this blog along with others that have been posted in attempt to try to paint a picture of me personally as a person that scammed them. I have included a few web sites that you can go to that show that not only were short pay refinances very legit, but FHA is actually doing loans for them. I am also now starting to talk about what has happened while I was employed with OF Lending Group and how I became involved in these transactions.
It has taken 13 years for me to build my reputation and have acted ever since with honor and integrity. I do not claim that I wasn’t involved in selling short pay refinances. I was involved in the time period of starting around September 2009 until May or early June 2010. I stopped selling the Short Pay Refinance completely at that point, for no other reason then the banks were not doing as many as we previously though or were lead to believe.
In our industry during that time their was unrest among home owners due to the fact the housing market dropped along with the values and equity that everyone had in their home. I was also someone that was involved with loosing over 500k in the home I bought and then later Short sold because the bank I was working with would not do a Short pay Refinance due to me being behind on payments. I was behind because I was following the instruction of the person that represented B of A and said that “They would not do anything or even Talk to me until I got behind” So as a home owner with just about everything I had into my home I did as they suggested. Once that happened I was told that they wanted to see document after document after document. I provided them with what they asked for each time and found that they always said I did not send it or they did not receive it. It was a pattern that I found to be incredibly discouraging and I was just about out of hope. Around this time the Short Pay Refinance was brought to life and it was definitely not created by me yet brought to my attention from the broker I was employed with William Hogarty and OF Lending Group. There was a large amount of information and evidence the showed that these transactions would help people. I was bitter because even after I put my home on the market to be sold and received an offer of 475k less then I owed, I still called B of A and said I will give you 100K more then the offer and asked to please let me keep my home. I was then asked to provide the offer along with another batch of paperwork of about 70-100 pages and was told they would get back to me. I waited and hoped for the 2 week period to go buy in which I was told they would give me an answer. Time went by and on the 14 day I called and was told that because I was not current on payments, which they suggested, then I would be turned down for my request of paying even 100k more for the home that was my dream home.
I share this because, as the time of the Short Pay came around and was widely publicized, I was in the brink of loosing my home and all because the bank told me to get behind. When it was said and done, my home was gone and I was led to believe that if I were current then I might have had a chance. The government along with other companies and major banks were publically advertising that they did short pays and provided literature to everyone that this was a true and legitimate way to help people keep there homes. I although hesitant to sell these at the beginning decided that my belief of it sounded to good to be true was actually posted everywhere and they were happening.

This was in addition to the broker being an actual mortgage lender telling us the reason why banks would do these transactions as it was the cheapest way out for them. These conversations were accompanied with Testimonials provided by the broker. With seeing much of what the concept of short pay finance was about in just about every marketing ad from different lenders. That’s when I whole hardily believed within my self and belief system that this was what was needed to hopefully prevent people from going through what I did. I began selling them under the platform that my broker created. There was an entire team of people that worked on these files and were in communication with the lender and the client. I was not involved in this process and was only involved with the initial point of contact and explaining the way the process worked. I always told people that it would take between 5-8 months to complete so please be patient. That is the time frame that most everyone represented to be the period expected to complete this transaction. The government was involved with restoring the market through the T.A.R.P. program and although its intent was to help, it ultimately did not work as the banks, government and you and I had expected. Things changed regularly at during the mortgage crises it was a moving target, yet I saw few of the short pays our office took in starting to get completed. Again I started with this process about 2-3 months after the broker suggested we sell them.
I still had not had any complaints or issues with the results at the beginning of the year, due to the idea I had and presented to the client that we were still in the stages that our dept. that dealt with the negotiations were explaining to us, not only verbally but in writing with communication with the bank. Again I believed these transactions were working. The contract was never written by me nor did it have my name on it anywhere. It was written by the broker and a Dept. Of Real estate attorney. I was given explanation in writing that the contract we had was allowed after the advance fees agreement was introduced because of the way that our company had worked on these files and had specific information regarding what people were agreeing to. Again, I was 100% under the impression both with explanation and in writing that the advanced fee being stopped were due to the crooks out there taking money and not intended for the legitimate companies that were really helping and creating positive results. Again, with the staff that was working on these transactions and proof that they were getting these done along with the information we were told and later confirmed that we were ok to operate as we did, well at least on the sales level where I along with every employee in the company were told and led to believe. I was also not the person that any check or money was paid directly to me and instead to the company name of OF Lending Group. Therefore I was not exposed or involved with the earlier complaints due to the fact that I started selling them a couple months later then some and because I was not the person that people had the agreement with. Around May of this year I started receiving complaints about the time it was taking to complete the period that was believed it would take to complete the transaction. I was lea to believe this was normal, yet started to have concern as guidelines changed. It was at this point I started telling people I will not accept any B of A clients as they have now publically expressed they would not except short pay refinances.
Other banks were still providing approvals, well the ones that were getting done and emails that were shared of a success story and completion went throughout the office. In the time period of late May, I decided that the clients I had worked with and explained the program to were now getting upset and started asking for refunds because the transaction they hoped for did not get approved. Although, I always shared that it was not a guaranty, however I believed with the fact, that the clients met the criteria in which HUD had said would be allowed and along with the qualifications set by the broker and after these were confirmed to be true, that in fact they were qualified. This is how and why I sold these and believed they would have a chance of getting done.

Once the complaints came in and I started to have to defend the reasoning behind the fact I was selling these, then I completely stopped these transactions and came up with an agreement with the broker that I would forfeit and pay back 100% of the money I earned for the commission to go back to the client just so I could clear my name. I have this agreement and have provided to the people investigating this case. At that time I was having my paycheck deducted regularly to pay back the clients that complained. This information was given to me by the broker also in which I have documentation to prove that I was doing what I thought was right, yet the amount I earned was a miniscule amount to what the agreement was, yet to save face it was worth it.
Unfortunately the agreement was with the broker and my forfeiting the commission earned on my part was far from the amount that people wanted returned. This was far out of my ability to negotiate with the broker and although I did what I could do to clear things up, the broker did not. Because I am involved with the initial start of the process and the fact that the broker has not agreed to pay people back does not mean I scammed you or anyone. I am confident that the information I have provided to the DRE and the investigator in this case will be sufficient to prove the things I write in this blog. My intent with writing this is to show people that their are some extremely upset people and rightfully so, yet even though I was the initial point of contact and provided them something that was new and widely publicized and to this date still being sold, the fact that they feel they have not gotten there money back from the broker and the reason they feel they were scammed is entirely in the reason that the broker has not given them there money back and has taken with most a position of aggression. I have done everything I can including paying back the money to these clients, and not because of an admission of guilt on my part, but simply because I felt that I didn’t want to be a part of whatever reason the broker had to not pay these people on the contract he had with them. This was not my decision nor did I just turn my back on clients. I have stood up and defended and argued with the broker to make things right for the simple fact that people were upset and I was involved. I was told that it was not me paying the staff and I wasn’t out all the money for the salaries paid and I had no right to spend the company’s money.
I share this story because I will no longer sit back and let people form opinions based on what they are reading. If you or anyone would like I will meet and share what I have to prove every single thing in this blog is correct and true. I took 13 years to build my reputation and ill be damned if 8 months of selling the short pay refinance will bring me and my family down. In the end it wasn’t the fact that I was selling anything illegal or false it was the fact that the broker did not give full refunds back to people that signed up. I did and was willing to continue through he time I was working there, and all the way to the point of me leaving the company and being told that I still had a balance owed for refunds.

My name is Fred Wilson, I was out of town on a business trip when these allegations were made against Jim Rivera. As I returned home to livermore I heard that Jim Rivera and some others from his company had been slandered on the internet. I am here to say that I have done business with Jim on several occasions and have found him to be a very professional man. I will not allow a group of dissappointed individuals ruin his many years of good business. I know the type of business he normally does and the wealth of knowledge he possesses. Not to mention that the company he worked for the last years was at one point rated one of the best in the nation. I am personally goingt through mortgage crisis like many in California and the rest of the United States. that does not give me the right to verbally attack a group of people who ultimately are NOT responsible for my house no longer having equity or that my finances are not enough to support a lavish lifestyle. The entire nation is in turmoil. Why does no one rant and rave at the Lenders who are really responsible. Why is not a one of you blogging about the many billions of dollars wasted in the so called "Bail Out". I can see that it is easy to attack a group of well intentioned people who believed they could make a living and weather the storm by assisting those who need assistance. I myself went into Jim's office. He turned me awas as I had fallen behind on my payments already and had no chances of refinancing under any means. It's a shame that like any business there is the cost of business. Many will be helped, others will not. If Jim Rivera did such a thing as you accuse him of doing, why have you not moved ahead with a real action against him? I read the 7 page agreement that was used. I understood the legalities of it and what it meant. I would gladly have paid the company their fee to at least try something. the fee that I would have had to pay Jim's company AFTER they did some preliminary things to see where I really stood is nothing compared to the thousands of dollars I have paid in the last 2 years in interest to my lender BofA. who is currently in 3 Class Action Law Suits for having incompetent employees and not following through with the HAMP program. I am just as angry at the bank as all of you. And the real estate agent that took 20 thousand dollars from my loan and ran to never be seen again. why don't you guys blog about them????
I noticed there are several negative postings. I will make sure that I am heard on as many as I find. and I will inform several of my employees who have worked with Jim as well so that hopefully we can balance out this one sided story. I understand that these websites are to prevent innocent consumers from getting ripped off and so on. That is a great service, but it should not be allowed to be manipulated into a weapon that can damage a persons reputation and for those people in a dying industry it can ruind their entire livelihood. how would you like it if someone at your job discredited your ENTIRE career by you making an unclear deal. or simply not making a client of yours happy to their expectations and not the realistic ones???
I think some of you are missing the point. As intelligent people I would assume that you would understand that I do not blame Jim or William for not being able to secure any modification of my loan. I blame them for what they promised during our first and second meetings and have yet to follow through on. Jim promised on behave of William Hogarty that if they were not able to accomplish what we all wanted the bank to do then our money would be return to us. This has not happened. I have letters and statements from Wells Fargo saying that the paperwork was incomplete and untimely. If they were a "preferred" lender with Wells as they claimed to be then that should not have happened.
I blame them for the loss of time and the $10K I paid them. If you bought a product and the product was defective would you return it or just eat the cost?
It also seems fishy to me that all the "supporters" of these two people have hit on the same points, said the same things, and were away at the time. Please form your own opinions but to me it looks like some "supporters" and the rants they have posted seem more like a defense by the individuals and not a third party.
I am writing this response to Ben and his continued accusations that I am apart of him not getting the refund he requested. When I met, he was sent to me froma realtor friend of mine that had talked to Ben and he wanted to find out more about the Short Pay Refinance. I scheduled an appointment with Ben and explained the program and the process. I stated that there was No Guaranty and especially with the bank he was with as they were difficult to work with. Ben agreed to move forward. I am an employee of a company representing a product that was real and advertised as something to help people that were underwater in their home. Ben was handed the contract that was to enter Ben and William Hogarty into an agreemeent and Ben took that contract home. A couple of days later Ben called me and said he wanted to move forward and signed the agreement. I then passed it on to the Auditor of the Short Pay Dept. and went along doing my job. I was not a person that interacted with the banks and updating or communicating with the clients. When I was informaed that Ben was upset because he starting reading the blogs originally posted by Lisa Paring, then he asked for me to set an appointmetn with William Hogarty. I forwarded the email to Bill and he responded to Ben to schedule a meeting. When Ben and his wife arrived They met in Bills office and I asked to sit in. Ben asked me a few questions in regards to things I said in our initial meeting and I agreed that I infact said those things. Ben asked if the meeting could be taped and i said absolutely. the meeting then continued on between Bill and Ben for the majority of te time trying to come up with a figure that worked for a refund. Ben had his own interpretation of what he signed up for when he took the agreement home and again a different interreation after reading blogs. I cant say I would have been any different. But none the less the meeting was about Ben getting a refund from Bill. After back and fourth for about an hour or so it seemed like they came to an agreement. I was even sent acknowledgement from Bill stating that Ben had agreed to his offer. I was made aware of this because un benounced to Ben, I had agreed to pay back 100% of any commision earned on any clients that were unhappy of the results they were getting. I have this in writing and the conversation with Bill wether a higher or lower agreed to refund to Ben was accepted, it did not matter to me one bit, because I allready forfeited the commision money and stood nothing to gain with their agreement. When I agreed refunding my commission back in early July, I did this not because I did anything wrong in any way shape or form, but instead to assure that i was trying to do right by showing the clietns i represented that I was not going to profit in any way with them loosing money and being unhappy about the result. I have a documented agreement with these facts. I am not responding to this because I dont think Ben has a gripe. I am responding because Ben is making a deliberate attempt to classify me as someone that scammed him out of money.

If I was not the one who wrote the contract or any check for services made in my name for any agreement then how am I a scam artist or even anything close? I represented something I believed in and within the scope of my License and integrity. I made no personal guaranty and if i did and failed to follow through the I would understand how i would be catergorized as a scam artist, but I DID NOT! I am definately not here to defend the contract or agreement that Ben signed. I didnt write it, and I stood little to gain for anybody that signed it, so I believed under the advisement of Bill Hogarty that it was correct in every way. To this day, it has not yet been determined that the contract was illigitimate in any way. Either way if its found to not be correct, then it was not me who wrote it or signed it as accepting the agreemetn between the client and the company. I represented the product, of which i felt was something that would help the consumer and create a more stable housing market if the banks that have been proven to be greedy would accept. When Ben came in to meet with Bill the conversation and arrangemetn to meet was between Ben and Bill. I sat in and was asked if i said certain things. A person hiding or trying to mislead anyone would have denied, but no i said YES i said that. I did not try to lie because i believed in what I said in the first place. Wether or not the offer that was given to Ben was good enough or not had nothing to do with me. You see what ben did not know is that i offered to give back 100% of my commisio earned in July of this year to any client I represented felt that they didnt get the service they wanted. I stood absolutely nothing to gain with the hour and a half negotion of an acceptable amount betweeen Bill and Ben. Wether Ben accepted less or Bill paid more had nothing to do with me other then if Ben didnt win then I was involved and Ben would be upset with me also. That sad considering the agreement was not with me personally to provide services and I didnt profit for this agreement as I have willingly, prior to any blogs offered to pay back my commission. This was done only to prevent this stuff of peoples perception of my involvement from ever getting to this point. I will not defend Bills actions upon customer requests of refunds and I have my own grioe of how things were done and handled yet, the complaint should be directed at the person in which the written agreement was with. I have taken verbal assaults for my affiliation with Bill, and what people thought of him, yet the assault that I am taking for this company and the actions of Bill are not a reflection of me or my integrity as i was not someone that had any right the money or the deccisons for that matter of where it was spent o deposited after agreemetn was made. Therefore how was i responsible for Bills actions for not giving enough or in some matters anything back. I challenge anyone to show that I personally gave a guaranty and failed to uphold my end f the bargain. Now the fact that people may feel Bill hasnt is between you and Bill. I have allowed the negative perception of me to grow for too long now and prior to me talking and defending my action or belief to sell this product, i have made sure that all I say I can proove. Unless anyone can proove that I deliberately did anything wrong or outside the scope of my license than please stop assuming that I have anything to do with Bills response or lack there of to your request for money back. If the deliberate attempts to smeer my name continue then I will defend myself, my integrity and my livelehood with everything in me. I do not claim people dont have the right to be upset, I can definately tell you that I do not defend the actions of Bill in any way. The perception painted of Bill is his battle to fix, the perseption to clear my name is mine, and instead of running, I will face any question or concern head on. I was contacted by Jim Rivera about 6 weeks ago when everything was going to hell at OF Lending. I used to work with Jim, but up until 6 weeks ago I don't believe I've talked to him since leaving the company 10/31/09.
Jim called me to tell me that he wanted to clear his name. He said he only stayed with OF Lending because he thought he would get paid back commission that was owed to him and that he basically couldnt' afford not to be paid. He admitted to me that the short pay program was not as William Hogarty said it was and said he stopped signing people up when he learned this. I told him that I personally had an issue with the fact that he charged different people different amounts to which he replied that he was a salesperson doing his job. He made no apologies for this. When I asked about why he continued to sell the short pay product, he said he based EVERYTHING on what William Hogarty told him and never questioned anything or bothered to just simply draw conclusions based on what was easy to observe. Again, he said he was only a "salesperson" despite the fact that he had a vice president title that he used to get people to trust him.
Here are a few facts:
FACT #1: Last night Jim personally threatened to sue me if I said/posted anything negative about him. So apparently he has no problem having people post good things about him on these blogs, yet when someone tells the truth like I am they are threatened with a law suit. To this I say "bring it on". The TRUTH is an abosolute defense to slander etc. I was actually on the fence a bit with Jim because he keeps telling me that he is willing to do what he has to in order to clear his name. I just didn't realize until last night that this included threatening to sue anyone that dared to express an unfavorable OPINION of him.
FACT #2: Last night Jim informed me that he is taking legal action against others that have said negative things about him. So I guess these victims that have come forward after being screwed once are now going to be victimized again by Jim Rivera's "legal action". In my humble opinion, this is about as low as you can get.
FACT #3: 94% OF THE PEOPLE THAT HAVE CONTACTED ME BECAUSE THEY FEEL THEY WERE SCAMMED WERE SIGNED UP BY JIM RIVERA PERSONALLY. I'll let you all decide what this means.
FACT #4: Jim Rivera charged different customers totally different amounts for the exact same program. He was paid a higher split when he got someone to pay more. I have talked to customers of his that paid as little as $2,500 and spoken to others that paid as much as $10,000 (and the DRE complaint shows some paid even more). When I confronted him with this, he said he was only doing his job as a salesperson. There were no apologies for this and he in fact justified it as being what salespeople do.
FACT #5: Jim Rivera said he stopped signing up people for short pay refinances as soon as he realized it wasn't as William Hogarty represented and the success rate was nowhere near what William Hogarty said it was. I received a call from a from a victim that Jim Rivera personally signed up in August of 2010 which was long after Jim has admitted he knew the program wasn't as represented.
FACT #6: All the new posts on here that are complimentary toward Jim Rivera appeared AFTER he left OF Lending and AFTER he decided he wanted to clear his name. I wonder why no one said anything good before then?
FACT #7: Jim Rivera signed people up for short pays when he knew they didn't qualify for a new loan which was a requirement of the program. I am aware of one person that he signed up that didn't have the credit scores required and another that had mortgage lates which is not allowed and made it so the borrower never qualified for a new loan. Neither could get what's called a "DU Approval" which meant that they couldn't qualify for a new loan. In my opinion, this says that even though this "DU Approval" was a requirement of the program, Jim apparently Jim Rivera decided didn't matter. A short pay isn't possible if a borrower can't get a new loan.
FACT #8: Even I knew in 10/10 that Wells Fargo did NOT participate in the short pay program and I was truly just a "salesperson". Jim was a Vice President even though he now tries to downplay it so I find it hard to believe that he didn't also know this. He signed people up for the program knowing they had Wells Fargo loans. If you call Wells Fargo even today, they will tell you that they don't participate in short pay refinances. I had a borrower call them TODAY and this is what Wells Fargo told them.
FACT #9: Jim says he now wants to help those people that he signed up. I have therefore sent a few people to him that have come to me for help that he originally signed up. I've not heard back from any of them that he has done anything productive to help them get their money back. I invite him to prove me wrong with an update on what he's done to "help" those people that have contacted him for assistance. Please, prove me wrong and tell me that something good has come for these borrowers.
FACT #10: Jim resigned only AFTER the deal with American Pacific Mortgage was called off. He in fact resigned within 30 minutes of American Pacific Mortgage's decision to call off the deal. Had it gone through, I firmly believe he would still be working in an office run silently by William and Christy Hogarty and where William and Christy Hogarty were to be "stationed" and where William Hogarty is the person on the lease. I also believe Christy Hogarty was to receive a salary as some sort of branch manager for the very branch Jim Rivera was to work at (I have not confirmed this piece totally yet, but I do believe it to be true). Jim in fact threatened to sue me personally for killing the American Pacific Mortgage deal saying it was because of me that he didn't get to work for them (in the office William Hogarty leases). In my humble opinion, this suggests that he would still be working for William Hogarty today if not for this deal being called off and that he wouldn't have come forward to "help" had this not happened.
FACT #11: Jim seems hell bent on doing whatever he needs to in order to clear his name. Right after he resigned and after calling me, he immediately contacted the DA and the DRE AND THEN HIS LAWYER to offer them information saying he had over a year's worth of proof. Hmmmmm. Why would he have been collected "proof" for over a year if he didn't know something was wrong? Why didn't he come forward before when he first knew something wasn't right? Why would anyone stay for a full year if they thought something wasn't right?
To Jim I say bring on your lawsuit. You don't scare me one bit. You have hurt so many people and I get at least four calls a week from poor people that you signed up for a short pay program that are out up to $10K. Why don't you help these people like you said you will instead of being so focused on "clearing your name". As I have told you before, do the right thing and do right by these people and your name will be cleared in the process.
Now, I fully expect all sorts of horrible things to be written about me personally by Jim and his alias' on here that all appeared six weeks ago or after. For whatever it's worth, my only motive by spending my time on here is to help those that were scammed (94% of which so far were signed up by Jim personally). To that extent, please continue to email me if you need my help. I'm a bit behind responding to a few of you, but I will get back to you. 5. Did you or did you not hold off on trying to help get someone a refund (that you signed up in 5/10 that had a Wells Fargo loan) because you said if you pushed Bill on the refund you might not be paid by Bill first?
6. Did you or did you not charge different customers different amounts for the exact same program that had an acutal price of $4,000 and then $2,000?
7. Did you or did you not charge some customer $10,000 or more for the same program others paid $2,000 for and that Bill said he'd take $2,000 for?
8. Were you or were you not paid a higher commission split when you charged someone more than the actual price? Say $6,000 and $10,000.
9. What was the most you charged someone for a short pay refinance that could have been done for $2,000?
10. Did you or did you not look at the customer's bank statements to see how much cash they had before telling them how much the program cost? Did you charge them more when they had more in their accounts?
11. Did you or did you not sign people up for short pay refinances AFTER you said you realized it was a scam? Say Aug 10, 2010 for instance.
12. Have you or have you not asked people to write good things about you on here? In fact, did you or did you not tell me you hoped I too would write something favorable on here about you?
13. Did you or did you not resign within 30 minutes of the APM deal went belly up?
14. Were you or were you not going to continue to work in Bill's office after the APM deal went through?
15. Did you resign from Bill's employment right when you knew something was wrong, or did you wait for say a year and continue to sell his scam program and collect commission for doing so?

17. Why would you collect "evidence" as you called it if there wasn't anything wrong with the way William Hogarty and OF Lending were doing business? Do you always collect "evidence" for a year with all your employers when you don't expect there is a probllem?
18. Did you take Wells Fargo short pay refi files from people after you knew Wells Fargo didn't paritipate in short pays? When did you determine this was the case? Note: your customer above says it was quite some time back when you told him. I personally knew by Oct 2009 and I wasn't a vice president like you were.
19.Did you or did you not tell a Wells Fargo customer in May 2010 that you had "closed too many Wells Short Pays" to even count"?
20. Did you or did you not accept money and take a contract from a borrower that had socres in the 500's and despite the fact that they didn't qualify for a short pay and they never could have gotten one? And despite the fact that you couldn't get DU approval as requried? Were you paid part of what the customer paid OF Lending for a program he didn't qualify for?
21. Did you or did you not take money from a borrower that had mortgage lates in the last twelve months and that also didn't qualify for a new loan and a DU approval? Did you skip over the part of the contract that required a new loan and that without a new loan there was no point id signing them up for s ahorty pay at all? What was your split of this customer's funds when you signed him up for something he never qualfiied for?
As for why I invest my time in this, well frankly Jim, someone has to do it and it should be you since you are the source of 94% of the customers that call me and because you took money from these people and apparently don't feel like you should help make this right. In fact, you are clearly reading my posts about all the people that contact me and that they are your customers, yet haven't asked once if you can help any of them. Your posts on here and by the others you have post on here are self servicing in my opinion. If you cared about the damage that had been done, even if you want to cry "victinm" yourself, you would step forward and do what I am doing. Until you do and until I hear that you are actually helping people instead of things like not helping people get refunds to increase your chances of being paid, you can expect me to continue to post on here as time permits. I help hoping that one day if the roles are reversed that someone would help me. I'm a believer in karma too, both ways.
P.S. I don't think the DA has solicited information about me specifically or has any reason to investigage me for anything. Sort of sad that you can's say the same. I don't think the DA's office would invest resources into investigating someone if there wasn't some thought that that laws might have been broken. That's my opinion anyway.

I'm very sorry it doesn't appear that Jim Rivera followed through on his commitment to you and to me to help you get your money back. It appears that after his light duty email to Bill that he hasn't done anything. The day that he promised me that he would help you, he said at that time he was not willing to pursue the refund in any way that could compromise his ability to get paid the commission Bill apparently owed/owes him at that time. He said he wanted to be sure he was paid before anyone else, inlcuding you. He said that he really needed the money for Christmas and that he was hoping to get paid that week. He led me to believe that he would help go after Bill for you once he was paid and that he had ammunition (sp?) that would help you. It appears from your post that this never happened. I'm truly sorry.
I am also very sorry that I told you that I believed Jim.wanted to help. I read him wrong and was apparently suckered by him on this one myself. He stopped communicating with me after he asked me to post something positive about him on this blog, something I obviously never did. The time frame of his request is consistent with when these other nice posts happen to appear. I did text with him a few nights ago, but that didn't end well because I refused to promise to stop posting the truth about him even when he threatened to sue me. I now believe his only motive is/was to try to clear his name and to get himself out of trouble as he has yet to contact me about helping anyone else despite the fact that he is aware that I hear from at least four people a week that he signed up that are victims of the scam he accepted a commission to sign people up for. He seems to using a Bill Hogarty stall tactic of "I will meet you in person to discuss this with you" as I noticed this is what he had proposed as his way of "helping". He orignally tried very hard to get me to meet with him in person so he could show me all the "evidence" he has that he is not at fault and that will keep him from being charged criminally. Like others, I declined to take this meeting because his reputation and any criminal charges are not of concern to me. Should he make contact with you to try to schedule a meeting, I advise you to decline as well unless he agrees to talk only about your situation and what he's going to do to undo the damage that has been done and not talk about himself and all the other nonsense.
I can probably provide you with evidence that proves you were lied to and defrauded when Jim signed you up and accepted your money and the commission check paid to him that followed. I'm sorry that Jim Rivera feels the need to minimize your grief and that of other apparent victims by calling it "drama". Rest assured that there are many of us out here that know and understand what a tragedy this scam is and the financial crisis it has led to for so many.

Jim, can you please tell all of us what you specifically plan to do to help these people? Maybe I just misunderstood what you meant when you said you would help all the people that you were paid to sign up and were scammed. What does "help" look like to you and when can we expect to see it? Also, is it reasonable for those people that you charged and inflated price to (over $4K) to expect a refund from you personally for the extra commission you were paid by inflating the price? I'm thinking you received between 25 - 50% of the overage, right? It might not be a full refund, but it's better than nothing. Let us know your position on this please.
And please do all of us a favor and stop the "I will fight to clear my name" and blah, blah, blah. I speak for many when I say no one cares. You've earned your current reputation on the backs of all these people that were scammed. This isn't about you and your reputation anyway or about any DA or DRE investigation of you. It's about helping people that were stolen from and defrauded. I promise you that if you help these people and do the right thing that your reputation will recover in the process. Let me say that I am not a lawyer and have no legal training so this is based on my own opinion as just a lay person.
If you paid Bill Hogarty, Jim Rivera or OF Lending for a short pay refinance and it's not complete, my best advice at this point is to file a small claims suit against them AND to contact Rick Monge. Be sure to sue them personally in addition to the company. I believe the company will be out of business when Bill surrenders his licenses at the end of this month so a judgement against the company will likely be worthless. As the designated officer for the company and because there is likely fraud involved, I believe Bill to be personally liable. Jim Rivera was a Vice President and a member of the executive team, although I don't know if he too can be held personally liable.
I don't know when the office will be officially closed so in my view, your best bet is to use home addresses. Email me if you need an address as I can point you to the public records where this information can be found.

Instead of coming on here posting good things about yourself, why not address some important questions that your customers have?
In the later months, the base price for a short pay refi went from $4,000 to $2,000. Bill Hogarty offered up higher commission splits for everything over $4,000 that a customer paid. Just because Bill offered higher splits when you charged more doesn't mean you had to take advantage of this. Your doing so makes you no better than he is in my book.
Let me refresh your memory:
On 5/17/10 you signed a customer up and charged them $4,000. This was $2,000 more than they needed to pay since there was only one program.
On 5/25/10, one week after charging a customer a $4,000 inflated price, you charged a customer $7,000, a full $5,000 more than they needed to pay. I'm pretty sure the commission on this one file was $2,500, right?
On 6/11/10 you charged another customer $6,000, a full $4,000 over what they needed to pay. I think the commission paid on this one was $2,000, right?
On 6/14/2010, just three days later, your price was then $8,000 for yet another customer. This is a full $6,000 more than you needed to charge. It's not as if there was different programs that were different prices.
If I remember right, it was you that constantly bragged when you screwed a customer by charging more than what the base price was and scored a larger cut and commission check by doing so. Having a base price that you negotiate a discount on is one thing, but taking a base price and marking it up depending on who the customer was is totally different.
You have said that you only did short pays for 8 months. This is false, and yes, I can prove it. You were doing short pays in the spring of 2009 and probably before and you were still doing them in July 2010 and probably after. How is this 8 months?
You have said that people that didn't qualify for a new loan signed a different contract. Really? Do you want to rethink this statement? I can prove that in at least two cases you absolutely had the customer sign the regular contract. Not only did you sign one of these people up for a program she didn't qualify for, you had her sign the regular contract, you told her she qualified and you even charged her $6,000 for this program, a program she wasn't a candidate for. Why?
Please stop with your posts about yourself. You are the only one that cares enough about what you think of yourself to spend the time to read a 3 or 4 post statement written by you about you and how you are a victim when the people reading these posts have lost their homes and have had their families (including their children) hurt by what you did to them. You might sit on here and try to justify how it was a program meant to help people, even when you knew the success rate was not the 70% you were quoting, but I don't think you'll ever be able to explain in an acceptable way why you charged the inflated fees that you did that varied by customer. It's rather selfish in my book to have to read about your kids when I feel your pricing structure screwed people out of the money they needed to support and feed their own children.
P.S. Go right ahead and threated to sue me again. I'm still not afraid of your baseless "attorney" threats

Yes, William Hogarty has in fact filed for bankruptcy. However, if you received a notice in the mail that he is claiming you as a creditor that he is trying to get discharged in his bankruptcy and that was/is a victim of his short pay scam, don't lose all hope. I would suggest to you that you speak to an attorney immediately because the bankruptcy court will not discharge a debt that was as a result of fraud, which many of us firmly believes is the case. Also know that he is still being actively investigated by the DA's office for theft and fraud so criminal charges for fraud specifically are still VERY possible. No bankruptcy court judge is going to discharge a debt that exists as a result of a crime.

For those of you that are following this and that want to vomit everytime you hear William Hogarty's claims of "integrity", I thought I'd give a link to a web site that tells all about William Hogarty being busted for cocaine posession after his condo was searched by police. They found enough cocaine in his condo that they believed he was dealing. That's right, this "man of integrity" is nothing more than a low life coke dealer.
And it gets even better..... Once he was busted, he rolled over on his "suppliers" to save his own ass and became a police informant. In this role, he arranged for the purchase of a KILO of cocaine, yes a kilo, from his suppliers while he was wired and his phone conversations were being recorded by police. He paid his supplier over $25K for the kilo of coke and when he went to take delivery of his drugs at his supplier's residence, he gave the police a signal once he had the cocaine and the police raided the place and arrested his suppliers. Obviously he didn't cooperate with the police because it was the right thing to do. He did it because he knew he was facing serious charges himself.
Yep, not only does he have a past of dealing drugs, he's a SNITCH too. I can't imagine how that's going to go over if he faces jail time for "other" possible crimes. Isn't there special treatment by other inmates for SNITCHES?
To those of you that worked for William that are feeling bad or guilty about cooperating with the criminal investigation, I say to you that William himself is a snitch and what's more, he rolled over to save his own ass. So don't feel bad. Just know he'd screw you over in a minute if it would save himself just as he did with his cocaine suppliers.

For those of you that are following this that feel they are a victim of OF Lending, please know that my heart goes out to you and that what I am posting today will in no way deter my efforts to speak out and state the truth. It actually motivates me even more.
In court today, Jim Rivera tried to claim over and over again that he had no personal responsibility to those that lost money that he signed up for a short pay refinance, even when he gave the client false information. He admitted under oath today that he is not aware of a single Wells Fargo deal that was complete despite the fact that he took hundreds of thousands of dollars from people with Wells Fargo loans. And instead of just trying to get away with saying he wasn't personally responsible, he is now attempting to profit from this to the tune of $7,500. That's right, Jim is now claiming personal damages and wants to be compensated because all of this came out.
After a hearing today where I testified against Jim Rivera, I was served a lawsuit for $7,500 as he now says I cost him employment and income. LOL. The good news is that by him dong this, I can now finally give all of you evidence that Jim Rivera was paid an average of $7,500 per month in SALARY and commission over the last twelve months. This is in HIS own words in HIS sworn statement. So when he tells you he wasn't paid a salary and was just a "commissioned" salesperson, I can now give you documentation to prove otherwise. I'm not sure many of the people I've talked to would agree that making almost $100K per year clasifies anyone as a victim. And remember, a big chunk of this almost $100K came DIRECTLY from the checks YOU gave him for the short pay refinance program. When you gave him a check, he got a check with a cut. The bigger the check you gave him, the bigger his cut. I do have commission reports that I can send to you if you want proof of this in any potential claim against him. If it were me, I would consider this if I were making a decision about whether I wanted to pursue a claim against Jim Rivera personally.

I'm absolutely certain that this hearing will further reveal his involvement and knowledge of the scam just as was the case today. I don't think anyone other than Jim thinks he should profit from this very tragic situation. So you don't deserve your money back, but he should get $7,500. In my view, this is about as low as it gets.

I'll also keep all the "evidence" he submits next month when he tries to prove he's some sort of "victim" and will make it available to any and all of you. Finally, I will happily appear in court with you as a witness should you choose to file a lawsuit against Bill Hogarty, Christy Hogarty, JIM RIVERA, or anyone else at OF Lending. I do feel my input today when I testified for another victim was well received by the judge. And again, Jim suing me won't deter me from continuing to help. It's also worth noting that Jim Rivera was an officer of OF Lending until about 45 days ago so in my view there's a possiblity that he can be held personally responsible for ALL the losses. I can also prove that he collected "evidence" over the last year which obviously confirms he knew something wasn't right. In my humble opinion, a person doesn't collect "evidence" (Jim's words) unless they think a crime is being committed. I'll let you decide what sort of admission this might or might not be on Jim's part.
In closing, much was made today by Jim Rivera about my speaking out as if I should be ashamed of this. I wear my "whistle blower" badge with honor (and sadness for the victims) and my only motivation is to help those that have been hurt and there is absolutely nothing in this for me personally. Note when you watch it that he surrendered his license even though he is still claiming he is out of business because of "haters". Also note that the Department of Real Estate feels it was a scam. So when he claims it was the "haters" that shut him down, just know this is more BS and that his own actions is what shut him down. I guess he doesn't get that when you do business in this state you actually have to follow the law.

This part I'm a bit embarrassed to post, but I want you to see what he is doing with the money
you paid him for a short pay refinance. He hosted a "naughty lingerie party" a few months back. You'll note that his wife even has on a fur coat in one of the pictures. Hmmmmm. I wonder if they have sold it to pay back someone they owe money too. If you read the invite carefully, you'll see it talks about something like 100 handpicked women that will be at the party wearing naughty lingerie. Yep, that's what this man thinks of women. And that's what he is doing with money he stole, inlcuding money that is supposed to be in a trust fund for his customers that isn't there. I was made aware of this over the weekend by another person victimized by this man. I guess this also means he is paying women to walk around in "naughty lingerie" before feeding his kids too. A quick reminder to those of you that are following this because you feel you were hurt by the short pay refinance program.....
James Rivera, a.k.a. "Jim Rivera", a.k.a. "J.R.", has filed a lawsuit against me claiming I cost him opportunity by my going public with the FACTS that I have. If you'd like to attend, the hearing is this Wednesday, March 9th at 2:00 PM at the Pleasanton Courthouse on Stoneride Drive in Pleasanton. We will be in Department 702. During the hearing, I will of course have the opporunity to pose certain questions to Mr. Rivera that will hopefully again lead to his admitting his knowledge of the legal issues at O.F. Lending and his knowledge of the short pay scam. He was "smart" enough to appear last month at a hearing where he was forced UNDER OATH to admit not a single Wells Fargo deal was every done, despite the fact that he took money from people after assuring them Wells Fargo short pays had been done, so I expect even more will come out during this hearing. I plan to make sure this is the case. I'm actually looking forward to it because I hope to draw more admissions out of him, admissions that will help those of you that were lied to. You don't have to testify to observe. It's a public hearing so you can simply be present. I should note that James Rivera's current broker (basically his current boss) has been extended an invitation to this hearing and some people that feel they were victimized by Jim Rivera have agreed to appear and to testify in person. By the way, if Jim Rivera signed you up for a short pay refinance and it didn't work, you need to sue him in small claims court. Email me at lisa@lisaparin.com and I can tell you where on-line to find the forms. And while I'm not an attorney, they are very user friendly and I'm happy to give you my lay person's advice on completing them. Just know it takes all of about five minutes and this courthouse does have small claims dates and times in the evenings. And yes, I will be there to testify for you just as I have with others.

What's so crazy about all of this is that this great program that would save the world that Christy (thenextsecretmillioniare) and Jim Rivera are defending apparently didn't even work for them. Jim Rivera told me himself he lost his house to either a short sale or a foreclosure (I can't remember which) in the last twelve months and William and Christy Hogarty claim to be 14 months behind on their own mortgage and that it is in the process of a short sale. And this on top of the fact that he defaulted on his office building mortgage and the property was foreclosed on.
So I ask you...... If you would have known that when Jim Rivera was looking you in the eye telling you how great this program was and that he himself was facing short sale/foreclosure, would you have believed in the program? And if William and Christy Hogarty would have told you they stopped making payments on their building, the building many of you met this people at, and that is was in foreclosure AND that his own house was in foreclosure and that he stopped making payments, would you have signed up for his rescue plan?
How great and successful was it when the CEO and the VP of the company couldn't use this program to save their own houses?
And for those that are saying people that signed up did something wrong by trying to find a solution, just know that unlike Jim Rivera and William Hogarty, you have lived up to your mortgage obligation and what you did was far better than what either of them did with their own mortgages. Not only had William Hogarty defaulted on two mortgages himself in the last 18 months, but he is also trying to get ALL his debt, including what he owes to people as a result of ths scam, discharged in bankruptcy.
Well, unfortunately I just learned that the court case that was to be heard today, the one where Jim Rivera is suing me (LOL), has been postponed until May 4th. So for those of you that graciously agreed to attend today as a witness to Jim's actions, please know there will be no hearing today. Please don't worry though as they date was just pushed back and from what I can tell, the case has NOT been dropped. I believe this means we will still have our day in court and we will still be able to get him to admit even more than what he did at the last hearing where he was sued and lost. He can't win his lawsuit unless I have a chance to defend myself and question him which of course means I'll have to (get to) ask him about every case I'm aware of where those involved feel there was deception. You know, like those of you that Jim Rivera signed up and accepted payment from with Wells Fargo loans even though he knew Wells Fargo didn't participate in the program (they never have). I also have several documents he'll have to answer to including some that he admitted to stealing from William Hogarty.
Do know that at the next hearing, I am going to subpeona several people as I learned from being at the courthouse today how I go about doing this. So just know, several people will be there, including his current boss, that will have the opportunity to hear all the evidence I have that supports everything that I have said or written about him. These same people can speak to his true income, since that's what he's suing me for, and his previous income. The net of it is that he can't win his case unless he can prove I lied about something and so he will leave me no choice but to prove everything I wrote about him, is 100% true. I'm not sure why he wants all of this to come out in open court, but I'll certainly go along for the ride if he insists that I lay out the whole ugly truth.
As to why he postponed, I can only guess that someone finally told him how stupid this whole case is and that he stands to lose more than he could ever gain. Or perhaps someone just clued him into the whole First Ammendment thing. I hope it isn't dropped for good because I think his former clients that feel they have been victimized stand to gain all sorts of good information, evidence and admissions from his having to testify in order to try to win his case.
Now, if you feel you were scammed by Jim Rivera and the others, please file a small claims suit against him PERSONALLY. Attached is a link to the on-line forms. Jim Rivera, formerly a Vice President at OF Lending is suing us for slander, to the tune of $5000.00. We have not slandered him in any way. Everything we have said is the truth.

Update on the slander lawsuit against us by Jim Rivera. ??
Rivera did not bother to show up in Court! That shows what type of person he is. Filing false lawsuits, is generally frowned upon by the justice system. He had no evidence, because we never slandered him. The lawsuit was merely to inconvenience us, and had no basis in fact. The judge was going to Dismiss WITHOUT prejudice, which is standard if the Plaintiff doesn't show up. That would mean that Rivera could bring the case again at a later date. We asked the judge to Dismiss WITH Prejudice, and explained what a BS case this was, without merit, retaliation for filing suit against him to get our $7,000.00 back from the fraudulent OFLG scam, and designed to hassle us. Dismissing WITH Prejudice would mean Rivera could not bring the suit against us again. However, the Judge did us one better. He actually ruled against Rivera, and the judgment is in our favor! Whatever we said about Rivera, has been factual.

It's been quite some time since I've posted on here. Unfortunately in the last two weeks, two new victims of this scam have come forward after working with Jim Rivera. Both paid well over the normal $4,000 for the program and both had loans with the same lender that to this day will not participate in a short pay refinance,something we all knew, Jim Rivera included, was the case long before money was taken from these people.
Jim has moved on to a company called Provident Bank Mortgage. The address on his DRE license is false. He lives in Livermore. Email me if you need his home address. J-R Samuels has done an amazing job staying on this and I encourage you to email them at the address they've posted if you need help. Talking to them will probably also restore your faith in mankind after having been screwed by Jim Rivera and William and Christy Hogarty. You'll come to realize as a victim you are in very good company and that there truly are people out there that want to help with no expectation of anything in return.
As for Bill and Christy Hogarty, I can only say they aren't off the hook yet and that the legal process is slow, but not blind. Keep the faith that these two will ultimately see consequences for their actions. I promise you they aren't flying under the radar of those that can impose consequences.
